Hello Everyone...well the disappointing news came today that I didnt get approved

I'm so sorry, I wish there was something I could say or do for you.  Hang in there, hopefully someone will have some advice for you!

Lisa, I'm sorry you got denied. I forget what stage you are in. Do keep appealing it and do get a lawyer. It seems they will use every little thing to deny you whether that is true or not.

Some people do have to repeatedly appeal the decision. I can't remember if you said you had the help of a lawyer before. Sorry, it's hard to remember the details.

In the meantime, get the treatment for both panic attacks and an evaluation for depression. You might not get disability based or RA, but on these two things or in a combination. Panic attacks can be very disabilitating and since they have used this against you, I would do the best I could to address it and continue with the disability process.

Please go to "butyoudon'tlooksick.com" and in the SSDI section post to Carolyn Magura.  Her brother is an ALJ and she got her SSDI the first time and in 30 days!  She has been a great help to me.  She will guide you in exactly how to word your disability in the way that another ALJ will be compelled to award you.  I believe that you get another ALJ for this appeal.

Lisa, Is this your first denial? If it is don't be alarmed, most everyone is denied the first time. It seems to be part of the process by S.S for delaying payment. I went thru this and did go to court, as did someone else I know. After the court hearing I was approved. I would like to know where you are at in the process. Maybe I could offer more advice, but definitely listen to Deanna about going for treatment for your panic/depression. It seems our SS system is more likely to give us our disability when something else is going on. Its hard not to be depressed and panicky when suffering a illness like RA. If you can have your medical doctor/psycologist to write a letter for you. It will help alot.

Getting a letter is definitely one of the things my lawyer said that he is going to try and do for me.

I'm going to give you the link for my lawyer, not to specifically recommend him because I'm new with him. But he has a lot of good articles on his web site that might be helpful. The point in looking at these is to help you decide if a lawyer might help you get better results and some of the articles explain why view SS is taking (right or wrong).

Scout that link states that one must have postivie labs or changes in the tissue in a biopsy of the synovial membrane.

  1. The diagnosis must also be corroborated by either a blood test that is positive for rheumatoid factor, or positive for antinuclear antibodies, or higher than usual sedimentation rate or characteristic changes in the tissue in a biopsy of the synovial membrane.

Being sero-negative and neg. so far in all of my labs I guess I had better ask my Dr. for a synovial biopsy, just what I need.  Do you think that the changes on my x-rays might corroborate the Dx for me.  There is definate erosion and bone thinning.  No wonder so many of us are denied and need to fight for years.

Hello Everyone!!

Thank you all for the replies!  I am/was at the stage of the ALJ and I did/do have a lawyer.  One thing I could say is thank god the hearing is taped because what she said in the letter and what was said is two different things.  I dont know if I should go to the next step or not.  Hopefully I could talk to my lawyer today and see what to do.  It only took her a week to send me the letter.  The thing I cant really understand is the vocational judge said there is no jobs I could do and she is saying that I could do a sit/stand job..There is no way.  Also because I have anxiety/panic attacks does that mean I have to go to counseling??? The medication I take for it helps alittle but after this I might need some counseling to get through this.  This is too much for me.  What a great birthday gift...my b-day was on the 15th and got this letter on the 17th.
