Ok, how would you not know your boyfriends brother crawled into bed
with you? Have any of you been following this case?

A woman who had sex with her boyfriend's brother in her darkened room
late one night claimed she was raped, saying the man tricked her into the
act by impersonating her boyfriend.

But Massachusetts' Supreme Judicial Court disagreed Thursday, citing a
half-century-old state law that says it is not rape when consent to sexual
intercourse is obtained through fraud or deceit.

The high court said the state's rape law defines rape as sexual intercourse
compelled "by force and against (the) will" of the victim. The court cited a
1959 ruling it made in another case in which it found that fraud cannot
be allowed to replace the force required under the law.lorster39217.4388425926Sounds like she's just trying to play the stupid card. How can you NOT know?I haven't heard of this myself; but it should never have been allowed to go to court. It should have been thrown out from the start in my opinion.

No I don't think it is rape but her boyfriend's brother is a complete creep. It might be a fraud case for civil court but I can't quite see it as a criminal act.

Just my opinion.

I guess I would need to know more before I could have an opinion.  How was it discovered - did the husband walk in and find them together and then that is the excuse the wife came up with, or did she realize it in the middle of the act and scream out, or what?  There's not enough info to really understand it as far as this article goes.  Sounds very interesting though!

Men rule, nothing new.  Apparently, the brother crawled into bed with her while she was sleeping
and had sex her. She did not realize it was the brother until it was over.
Something like that. Seems strange to me.

Sounds like a good excuse to try the brother out.

Hum...after reading the article...and if I were the woman victim I'd say ..."YES...I WAS RAPED".

Wouldn't fraud or deceit be something that is against someones will?  Does rape have to necessarily include the violent part of the act to be rape?  I'm not sure I necessarily agree with that law on this one. 

 Personally, how in the heck do you not know?  I mean it has been 19 years since I have had a sexual partner besides my husband, but I would know if it wasn't him crawling in my bed!  Just by the way that person would move or even breathe.  And by the way they touch me or their scent. 

I would imagine there have been other cases like this before where women have said rape but it really was consensual and they got busted by their husband or boyfriend. 

I wonder if this is one of the reasons it can be so hard to prosecute someone for rape. 

I have to disagree with your comment on this one Cathy.  It is not just men that commit the act of rape.  I have a friend that is a lesbian and she was violently raped by another woman.  Although it is a majority of men that do commit that horrible crime.  I feel that a woman raping another woman is sorely under reported.  Man or woman, anyone can commit this crime.
